TERMS AND CONDITIONS FOR THE MALTA HERITAGE HUNT

1. Definitions and Interpretation

  • “Company”, “we”, “us”, “our” – The Malta Heritage Hunt.

  • “Client”, “you”, “your” – The person making the booking and all participants included in that booking.

  • “Services” – Our interactive, gamified city-tour experiences in Mdina, namely the outdoor escape-room/geocaching activity and the self-led walking tour.

  • “Contract” – The legally-binding agreement formed when we accept your booking.

Headings are for convenience only and do not affect interpretation.

2. Acceptance of These Terms

2.1 By booking, paying for, or participating in any Service, you confirm that you have read, understood and agree to be bound by these Terms and our Privacy & Cookie Policies.

2.2 If you make a booking on behalf of others, you warrant that you have the authority to accept these Terms for every participant.

3. Description of Services

3.1 The Malta Heritage Hunt is an interactive and self-guided “escape-room” style treasure hunt through Mdina using riddles and clues delivered via our printed materials.

3.2 The route is entirely outdoors and unsupervised; it follows public streets, pavements and heritage sites open to the public.

3.3 Typical duration: 90-180 minutes; distance: c. 2 km; surfaces: cobblestones/steps; accessibility may be limited in parts of the old city.

4. Eligibility & Participant Responsibilities

4.1 The activity is suitable for most ages and fitness levels. Children under 13 must be accompanied by a responsible adult at all times; the Company accepts no liability for incidents arising from unsupervised minors.

4.2 Participants must:

  • Comply with local laws, traffic regulations and any instructions on-scene;

  • Behave respectfully towards residents, fellow participants, property and heritage sites;

  • Wear suitable footwear and weather-appropriate clothing;

  • Carry their own water, sun protection and any personal medication as necessary.

4.3 You confirm that you and anyone you book for are in adequate physical and mental condition to undertake the activity.

5. Booking Process & Formation of Contract

5.1 Bookings are made online or by email/telephone and are confirmed when we issue a written confirmation.

5.2 We reserve the right to refuse a booking at our discretion; any monies received will be refunded immediately if we do so.

5.3 Group sizes, language options and any special requirements must be declared at the time of booking.

6. Prices, Payment & Fees

6.1 All prices are stated in euro (€) and include VAT at the prevailing rate.

6.2 Payment deadline: the full balance is due 14 days before the scheduled tour date. Failure to pay renders the booking voidable by us.

6.3 Payments may be made by credit/debit card, bank transfer, or any method indicated upon receipt of the booking request.

6.4 We reserve the right to correct obvious pricing errors and to change prices before a booking is confirmed.

7. Cancellation, Rescheduling & Refunds

7.1 By you:

  • Cancellation ≥ 72 hours before the start time – full refund.

  • Cancellation < 72 hours before the start time – 50 % of the quoted price is payable/non-refundable.

  • No-show or arrival > 30 minutes late – treated as a late cancellation, no refund.

7.2 By us: We may cancel or reschedule in the event of unavoidable and extraordinary circumstances (e.g. severe weather, civil unrest). You will receive either (i) a new date, or (ii) a full refund, at your choice, in line with the Package Travel & Linked Travel Arrangements Regulations (SL 409.19).

7.3 Refunds are processed to the original payment method within 14 days as required by the Consumer Affairs Act (Cap. 378). 

7.4 We are not responsible for any ancillary costs (such as transportation, accommodation, or exchange-rate differences) incurred due to cancellation.

8. Health & Safety / Risk Acknowledgement

8.1 You participate at your own risk and acknowledge that outdoor activities carry inherent hazards (uneven surfaces, traffic, weather, etc.).

8.2 You must follow any safety warnings in the materials supplied.

8.3 We recommend adequate personal travel insurance covering medical expenses, personal liability and cancellation.

9. Liability & Disclaimers

9.1 Nothing in these Terms limits or excludes liability for death or personal injury caused by our negligence, fraud or any other liability that cannot be limited under Maltese law.

9.2 Subject to 9.1, our total aggregate liability per booking is limited to twice the amount you paid for that booking.

9.3 We are not liable for:

  • Losses arising from events beyond our reasonable control (force majeure);

  • Indirect or consequential losses, loss of profit, enjoyment or opportunity;

  • Damage caused by your own negligence, failure to follow instructions, or breaches of these Terms.

10. Intellectual Property

All content (logos, text, puzzles, images, software) is either owned by or licensed to The Malta Heritage Hunt and is protected by Maltese and EU laws. No content may be reproduced, distributed or used commercially without our prior written consent.

11. Data Protection

We process personal data strictly in line with our Privacy Policy and GDPR.

12. Force Majeure

Neither party shall be liable for failure to perform its obligations if such failure results from events beyond its reasonable control, including but not limited to acts of God, war, pandemics, or governmental restrictions.

13. Governing Law & Jurisdiction

These Terms and any dispute or claim (including non-contractual disputes) shall be governed by Maltese law. The Maltese courts shall have exclusive jurisdiction, without prejudice to your right under EU Regulation 1215/2012 to bring proceedings in your country of habitual residence.

14. Complaints & Alternative Dispute Resolution

14.1 We aim to resolve complaints amicably. Please notify us in writing within 14 days of the tour date.

14.2 If we fail to resolve your complaint, you may refer it to the Office of the Information and Data Protection Commissioner (for data matters) or to the MCCAA’s ADR entity, or you may use the EU Online Dispute Resolution platform.

15. Severability

If any provision of these Terms is found invalid or unenforceable, the remainder shall remain in force and the invalid provision shall be replaced by a valid one that most closely reflects the intent.

16. Amendments

We may modify these Terms from time to time to reflect operational, legal or regulatory changes. The version in force at the time your booking is confirmed will govern your Contract. Updated terms will be dated at the top of this document and published on our website.
